INFORMATION ON PERSONAL DATA PROCESSING pursuant to the effects of EU Regulation 2016/679 Art. 13

Pursuant to and by effect of current legislation on personal data processing, defined in accordance with the provisions contained in EU Regulation 2016/679 of 27 April 2016 (hereinafter "GDPR"), we inform that the processing of data provided or otherwise acquired will be in full respect of fundamental freedoms, always adopting principles inspired by the correctness, legality and transparency and only for the purposes for which they are collected, so as to guarantee the protection and confidentiality of these data.

Under Article 13 of the Legislative Decree of 30 June 2003 No. 196 "Personal data protection code" (hereinafter also the "Code") and Article 13 of Regulation (EU) 2016/679 laying down provisions for the protection of individuals with regard to the processing of personal data and the free movement of such data (hereinafter also the "GDPR"), please find below the information regarding the processing of your personal data.

2) DATA PROCESSING

The data controller processes personal data, identification data, related to company operations, in its legitimate interest; it DOES NOT process the information relating to particular personal data under Articles 9, 10, GDPR.

By way of example only, the processed data are:

  • The "personal data" such as name, surname, company name, address, tax identification, administrative identification, phone, e-mail voluntarily submitted by you through our web site icetransformers.com ;
  • The "data" collected at national or international fairs, in the EU or non-EU countries, on the occasion of visits at the corporate office as well as meetings and appointments for commercial purposes;
  • The "data" sent or collected on a voluntary basis as part of trade operations (on paper, electronic, telephone data carriers) as well as of commercial, fiscal, administrative, consulting, professional relations and interactions.

3) PURPOSE OF DATA PROCESSING

Your personal data are processed:

A) Without your express consent (Article 24, letters (a), (b), and (c) of the Privacy Code and Article 6, letters (b) and (e) of the GDPR) for the following service purposes:

  • Manage and maintain the Website;
  • Manage commercial and contractual relationships with customers and suppliers;
  • Allow customers and suppliers to benefit from the services possibly requested by them;
  • Process contact requests;
  • Fulfil obligations imposed by law, regulations, EU legislation or an order of Authorities;
  • Prevent fraudulent activity or abuse: of the website, corporate brand and/or anything else owned by the company;
  • Exercise the rights of the Data Controller.

In the above cases the legal basis of the processing of your personal data consists in giving effect to a contract with you, or providing the service that you have specifically requested, or giving effect to an obligation of law or protecting our legitimate interest.
Your personal data, sent to us by you or collected by us in compliance with the current legal regulations, used exclusively by way of legitimate interest and suitable for corporate activities, such as commercial and fiscal ones as better specified below.

The data will be used for the execution of contracts in place with you, before their conclusion, as well as for operational, management, fiscal, administrative and legal needs.

B) Only upon your specific and separate consent (arts. 23 and 130 of the Privacy Code and Art. 7 GDPR), for other Purposes.

4) PROCESSING METHODS

Your personal data is processed using the methods indicated in Article 4 of the Privacy Code and Article 4 (2) of the GDPR, and more precisely: collection, registration, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation, erasure and destruction of data.

Your personal data is processed both on paper and electronically.
The data held by the data controller, are not profiled or automated or transferred to third parties unlawfully.
The data which can be acquired from visits to the website, of which the data controller has knowledge, are anonymous and used solely for statistical purposes.

5) RETENTION PERIOD OF PROCESSED DATA

The Data Controller will treat personal data as long as necessary to fulfil the purposes set out above and in accordance with the laws in force.

6) SAFETY MEASURES

The Data Controller has taken various security measures to protect your data against the risk of loss, misuse or alteration, such as the adoption of computer security systems.

7) ACCESS TO DATA

Your data may be made accessible for the purposes referred to in art. 2. A:
- to employees and consultants of the data controller, in their capacity of employees and / or internal controllers; - to third party companies or other parties carrying out outsourcing activities on behalf of the data controller, in their capacity of data processors.

8) DISSEMINATION OF DATA

Without your express consent (Article 24 letter a), b), d) Privacy Code and art. 6 lett. b) and c) GDPR), the Data Controller may communicate your data for the purposes referred to in art. 2 A) to Supervisory Bodies, Judicial Authorities, as well as to all those subjects to which the communication is mandatory by law for the accomplishment of said purposes. Your data will not be disclosed.

9) TRANSFERENCE OF DATA

The management and storage of personal data will take place in Europe, using servers located in Italy belonging to the Data Controller and/or third party companies appointed and duly named as Data Processors.

10) RIGHTS OF THE PARTY CONCERNED

In your capacity of interested party, you are guaranteed the rights set out in Article 7 of the Privacy Code and Article 15 of the GDPR, specifically, the right to:

  1. obtain confirmation of the existence or non-existence of your personal data, even if not yet registered, and their communication in an intelligible form;
  2. obtain information on: a) the source of the personal data; b) the purposes for which and methods by which they are processed; c) the logic applied in the event of processing by electronic means; d) the identification details of the data controller, data processors; e) the entities or categories of entities to which personal data may be communicated or which may come to acquire said data in their capacity of designated representative(s) in the State, data processor(s) or person(s) in charge of processing;
  3. obtain: a) the updating, rectification, or, when interested, integration of data; b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law.
  4. object, in whole or in part: a) for legitimate reasons, to the processing of personal data concerning you, even if relevant to the purpose for which it was collected; b) to the processing of personal data concerning you for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication, through the use of operator calling systems, by email and/or through traditional marketing methods by telephone and/or mail.

Where applicable, you have the rights laid down in articles 16 to 21 of the GDPR (Right to rectification, right to erasure, right to restriction of processing, right to data portability, right to object), as well as the right to lodge a complaint with a supervisory authority.

12) MINORS

The data controller does not handle the data of minors. In the event that information relating to minors is unintentionally recorded, the data controller shall promptly delete it at the user's request.
